These Terms of Service ("Terms") govern your use of Bumps ("the App", "we", "us"), a Wix App Market application providing checkout bumps and post-purchase upsells. By installing or using the App, you agree to these Terms. If you do not agree, uninstall the App via the Wix App Market.
1. Eligibility
You must:
- Be at least 18 years old (or the age of majority in your jurisdiction).
- Have a valid Wix account in good standing.
- Have the authority to bind the legal entity that owns the Wix site where the App is installed.
2. Service description
The App provides storefront offer surfaces across the cart, checkout, product page, and thank-you page, plus a dashboard plugin to configure them. We continuously refine the App; minor feature additions and performance improvements do not require notice. Material changes are communicated via the dashboard or a release note.
3. Plans, billing, and trial
- The App offers a free plan and two paid plans (Starter, Growth). Pricing is shown in the App Dashboard's billing page; Wix handles all payment collection, taxation, and invoicing.
- A 14-day free trial is available on each paid plan, once per installation. Cancellation during the trial avoids any charge.
- Paid subscriptions auto-renew monthly via Wix until you cancel. On cancellation, paid features remain available until the end of the current billing period; thereafter your account reverts to the Free plan.
- Prices are quoted in USD. Wix may charge applicable taxes and currency-conversion fees per their Terms of Use.
4. Acceptable use
You agree not to:
- Use the App for any unlawful purpose, including violation of consumer-protection laws, advertising regulations, or sanctions regimes.
- Display offers that are deceptive, infringe third-party intellectual property, or promote illegal goods or services.
- Reverse engineer, decompile, or attempt to extract source code beyond what is permitted under applicable law.
- Use the App's API endpoints in a way that materially exceeds the per-route rate limits, or in a way designed to deny service to other installations.
- Submit content that is illegal, defamatory, hateful, or violates Wix's App Market guidelines.
5. Your content
Headlines, descriptions, and translations you author remain your property. You grant us a non-exclusive, worldwide, royalty-free license to host, transmit, and display your content as required to operate the App on your behalf.
6. Data, privacy, and security
Our handling of merchant and shopper data is described in the Privacy Policy. Salient points:
- We process shopper analytics on your behalf (you are the data controller; we are the processor).
- We do not store your Wix OAuth tokens — the App mints a short-lived API credential per request.
- Uninstalling the App triggers a data purge; if Wix never delivers the App Removed webhook, a scheduled reconciler performs the same purge.
- Data export and erasure are available on request from your dashboard session or by emailing support.
7. Service availability and limitations
- The App is provided "as is" and "as available." We target 99.5% monthly uptime but do not guarantee any specific availability.
- Storefront widgets gracefully degrade: an outage of our backend causes the widgets to render no bump (a no-op for the shopper).
- We may temporarily throttle or disable installations that breach the rate-limit safeguards or trigger repeated security violations.
8. Suspension and termination
- You may uninstall the App at any time from the Wix Apps page.
- We may suspend or terminate your access if (a) you breach these Terms, (b) Wix suspends your underlying account, (c) you initiate a payment chargeback after a successful billing cycle, or (d) we are required to do so by law or court order.
- On termination, sections 5, 9, 10, and 13 survive.
9. Disclaimer of warranties
THE APP IS PROVIDED WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that the analytics counters match shopper-level reality with absolute precision (sendBeacon delivery is best-effort by browser specification).
10. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App is limited to the greater of (a) $50 USD or (b) the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or exemplary damages, including lost revenue, lost data, or business interruption.
11. Indemnification
You agree to indemnify and hold us harmless from any claim arising out of your content, your breach of these Terms, or your violation of applicable law.
12. Changes to these Terms
We may update these Terms periodically. Material changes will be announced via the dashboard before they take effect. Continued use of the App after changes take effect constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflicts-of-law provisions. Disputes will be resolved exclusively in the courts of the State of Delaware, USA, except where local consumer-protection law mandates otherwise.
14. Wix relationship
The App is a third-party application built on the Wix App Market platform. Your use of Wix is governed by Wix's own Terms of Use and Privacy Policy. We are not affiliated with Wix.com Ltd.
